Flat-fee eviction lawyer pricing for Capital Region landlords
Our flat fee for a residential eviction in Albany, Schenectady, Rensselaer, and Saratoga counties is $1,500, including the court filing fee and process server fees. Add-on fees apply only if your case requires them or you choose an optional service. Commercial evictions start at $2,500, and we send a written quote before you pay anything.

The $1,500 flat fee for residential evictions
Residential eviction: $1,500 flat fee, including the court filing fee and process server fees. Covers preparing and serving all required notices, filing the eviction action, and one court appearance.
The notices are the ones your case needs, such as a rent demand for a nonpayment case (RPAPL 711(2)), a non-renewal notice for a holdover case (RPL 226-c(1)(a)), or a notice to quit for a licensee or squatter (RPAPL 713).

Additional costs, only if your case requires them
The flat fee includes one court appearance.
Each additional court appearance, $400; trial or contested hearing, $750 (an additional appearance fee may also apply).
Before we send an invoice for an add-on, we notify you in writing. We never charge more than your engagement terms set for that add-on, and we may charge less or waive it.
Optional warrant coordination
If the court issues a warrant of eviction, a sheriff, marshal, or constable carries it out (RPAPL 749(1), (2)(a)).
Optional, after the warrant is issued: Our $250 coordination fee if you want us to deliver the warrant to the sheriff or marshal and coordinate the removal for you. Otherwise we send the warrant to you, and you work directly with the office that carries it out.
Any officer’s fee is separate from ours.

What’s not included
Collection of money judgments and appeals. If a tenant files counterclaims, we will quote that work separately.
Counterclaim work comes with its own written terms, which you can accept or decline.
When you’re charged
You pay nothing for a residential case unless our attorney accepts it. When we confirm the acceptance in writing, we tell you how to pay the flat fee.
The full flat fee is earned when we begin work on your case. We begin work when our attorney accepts your case.
For a commercial case, we send a written quote after our review. If you accept it and our attorney accepts your case, we tell you how to pay when we confirm the acceptance in writing. Add-on fees are invoiced separately, after we notify you in writing.

Do I pay the court filing fee or process server fees separately?
No. For a residential eviction, our $1,500 flat fee includes the court filing fee and process server fees. Any officer’s fee for carrying out a warrant is separate from ours.
Will I pay more if my case needs another court date?

No. Our residential fees are the same whichever court in Albany, Schenectady, Rensselaer, and Saratoga counties hears your case, whether that’s a city court, such as Albany City Court or Troy City Court, or a town court, such as Colonie Town Court.
