Albany County eviction lawyer for landlords
An eviction case for an Albany County rental is heard in the local court for where the property sits: one of three city courts, a town court, or the Altamont or Menands village court. We take cases in all of them, and this page lists each one.

Which local court hears a case depends on where the property sits (RPAPL 701(2)). We take cases in each of the courts listed here.
City courts
A city court hears cases for rentals inside its own city (UCCA 204). For a City of Albany rental, our Albany page covers the city’s permit rule and Good Cause law.

Court hours that vary across the county
The county’s courts don’t keep one schedule. As of October 8, 2026, Watervliet City Court closed at 3:00 p.m., an hour before Albany and Cohoes, and Albany City Court opened at 9:00 a.m., an hour after the other two. Colonie Town Court sits on set days, including two evenings a week.
Each court’s entry above shows where its details came from and the day we read them. Courts change their hours, so if you plan to go to one yourself, check with it first.
Eviction lawyer for landlords in the Town of Colonie
The Town of Colonie includes two villages, Colonie and Menands. The Village of Colonie has no court of its own, so a rental there goes to Colonie Town Court in Latham (RPAPL 701(2)). Menands has a village court, which we also take cases in.
A Colonie rental can have an Albany mailing address, as our own office does: we’re in the Town of Colonie. That address doesn’t put a property in the City of Albany, so we confirm the municipality before we file.
As of September 29, 2026, the Town of Colonie hadn’t opted in to Good Cause Eviction.

Good Cause Eviction in Albany County
The state law applies only where a municipality has opted in (RPL 213(1)). As of September 29, 2026, the City of Albany was the only municipality in Albany County to have done so. The state agency that runs the program, DHCR, posts a statewide list of participating places; the latest is dated May 4, 2026.
For a rental in the city, see our Albany page. Our Good Cause page explains the exemptions and what the law requires in a case.
Waiting periods New York law sets
These are minimums, not a forecast. The court’s calendar, adjournments, and stays can add time, so we don’t promise how long a case will take.
- A rent demand must allow at least 14 days (RPAPL 711(2)).
- A non-renewal notice allows at least 30, 60, or 90 days; the longer of the tenant’s time in the unit and the lease term sets which (RPL 226-c(2)).
- A licensee or squatter gets a 10-day notice to quit (RPAPL 713).
- The petition is served at least 10 and not more than 17 days before the hearing, unless the Appellate Division’s rules for a court provide a different nonpayment schedule (RPAPL 732; 733(1)).
- If either side asks when the tenant answers, the court adjourns the trial for at least 14 days, unless both sides agree otherwise (RPAPL 745(1)).
- Once the landlord has a judgment and a warrant, the officer must give at least 14 days’ notice in writing before executing it (RPAPL 749(2)(a)).
If the statute’s conditions are met, the court may also delay issuing the warrant for up to one year, on the occupant’s application, in a residential case (RPAPL 753(1)). In a residential case based on a breach of the lease, the court must hold off issuing the warrant for 30 days so the tenant can correct the breach (RPAPL 753(4)). Our notices page explains which notice a case starts with.
The cases we bring in these courts
We represent landlords in nonpayment cases, holdover cases, and licensee and squatter cases in these courts. Our flat fee for a residential case doesn’t change from one court to another. Add-on fees apply only if your case requires them or you choose an optional service. See our pricing page. The process page walks through a case from notice to possession, and our attorney reviews each case before we accept it.
Frequently asked questions
Which court hears a case for an Albany County rental outside the City of Albany?
The court for the area where the property sits (RPAPL 701(2)). Inside Cohoes or Watervliet, that is the city’s court. Elsewhere, the county’s town courts and the Altamont and Menands village courts hear these cases. We match the address to its court before we file.
What time do the city courts in Albany County close?
Albany and Cohoes City Courts at 4:00 p.m., and Watervliet City Court at 3:00 p.m., as each court’s page showed on October 8, 2026. Check with the court before you go.
Do you take cases in the Altamont and Menands village courts?
Yes. We take cases in both, as well as in the county’s city and town courts.
Does Good Cause Eviction apply anywhere in Albany County besides the City of Albany?
As of September 29, 2026, only the City of Albany had opted in. A town, village, or city can opt in later, so we check the state’s filings for each case.
This page gives general information, not legal advice about your case. We represent you only after our attorney accepts your case and confirms it in writing. See our disclaimer.
